Liability Waiver and Release

Endorfin Wellness, LLC

I, the undersigned, hereby expressly and affirmatively state that I wish to participate in individualized group or personal physical training, exercise, weight loss and/or fitness classes to be conducted by Endorfin Wellness, LLC. I realize that this activity involves risk of personal injury, serious disabling injuries, damage to property and, in extreme situations, the possibility of death. This includes, without limitation, (a) your use of all amenities and equipment in the facility and any off site location and your participation in any activity, class, program, personal training or instruction, (b) the sudden and unforeseen malfunctioning of any equipment (c) our instruction, training, supervision, or dietary recommendations. I also recognize that it is not possible for Endorfin Wellness, LLC, to specifically list each and every individual injury risk. However, knowing the material risks and appreciating, knowing and reasonable anticipating that injuries, disabilities and even death are a possibility in any exercise, fitness, weight loss or training program, I hereby expressly assume all risks, known or unknown, all possible risk of injury, disability and even death, which could occur by reason of my participation in any program or class conducted by Endorfin Wellness, LLC, or otherwise inherent in exercise, fitness, weight loss or training programs generally. I am aware that Endorfin Wellness LLC is not responsible for any lost, stolen, or damaged valuables or property.

I have had an opportunity to ask questions about Endorfin Wellness, LLC, programs and classes, and have consulted my physician before starting any exercise, fitness, weight loss or personal training program with Endorfin Wellness, LLC. Any questions which I have asked have been answered to my satisfaction. I am covered by a medical insurance plan and/or will assume responsibility for all bills/costs associated with injuries sustained while attending or participating in Endorfin Wellness, LLC’s programs. I fully understand the risks involved in my participation in this activity and knowing and appreciating these risks I voluntarily choose to participate, assuming all the risks of injury, disability or even death due to my participation. I further understand that Endorfin Wellness, LLC, has made no representations, warranties or promises about the results I will obtain as a result of participating in any of Endorfin Wellness, LLC's programs or classes, and has clearly explained to me that there can be no guarantee that I will reach my stated goals or achieve the results I desire by participating in any of Endorfin Wellness, LLC’s, programs or classes.

The undersigned on behalf of themselves, as well as their respective successors-in-interest, and/or assigns, irrevocably and unconditionally, knowingly and voluntarily agrees to INDEMNIFY AND HOLD HARMLESS, RELEASE AND FOREVER DISCHARGE Endorfin Wellness, LLC, its members, managers, principals, owners, employees and agents of and from any and all manner of action or actions, cause or causes of action, in law or in equity, suits, debts, liens, contracts, agreements, promises, liabilities, claims, demands, damages, losses or expenses, of any kind nature whatsoever, known or unknown, fixed or contingent, which the undersigned has, or may hereafter have, against any or all of them, individually or collectively. The undersigned hereby further irrevocably and unconditionally, knowingly and voluntarily, waives any right to bring an action, claim, proceeding or suit in law or equity against Facility, its members, principals, employees and agents in connection with any such injury, disability, death or property damage, to the fullest extent permitted by law. If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.
